Congressman Jim Jordan (R-Ohio) condemned Internal Revenue Service Commissioner John Koskinen’s “breach of public trust, dereliction of duty and negligence” today in a hearing before the House Judiciary Committee. Today’s hearing, entitled “Examining the Allegations of Misconduct Against IRS Commissioner John Koskinen, Part I,” focused on whether to impeach Commissioner Koskinen for his failures related to the investigation of the targeting of conservative organizations by the IRS.

The hearing featured Reps. Ron DeSantis (R-Florida) and Jason Chaffetz (R-Utah). Rep. Chaffetz is chairman of the House Oversight and Government Reform Committee, and is the sponsor of legislation to impeach Commissioner Koskinen. Rep. DeSantis is a graduate of Harvard Law School and an Oversight committee member.

During the hearing, Rep. Jordan made the following comments:

“Gross negligence, dereliction of duty, breach of public trust. … It seems to me a dereliction of duty when you wait four months to tell Congress. His chief counsel knew in February of 2014 that there were problems and a gap in [Lois] Lerner’s e-mails and he doesn’t tell us until June. His chief lawyer knew and he waits four months, and the reason he told us he waited four months was because he was doing his due diligence to make sure that actually happened. And part of that due diligence wasn’t even checking to see if there were back-up tapes available. I think that’s dereliction of duty.

“Here’s the other thing: breach of public trust. … We just heard the Democrats talk about problems at the IRS. They said the cyber security breach; we had GAO (the Government Accountability Office) tell us the tax gap at IRS is $385 billion. Their fundamental duty is to collect revenue due the federal treasury. They can’t even fulfill that. But they’ve got time to target people and make sure they destroy back-up tapes in the course of an investigation. For goodness sake this is certainly breach of public trust, dereliction of duty, and negligence in gross, gross form.”
